    Instead of suing a small business that serves a spicy dish, this idiot should only order spicy food at Popeyes and Taco Bell.

    Then advertisements write themselves. “Food so hot we got sued!” “Eat at your own risk, may cause injury”. “Food recommended by 9/10 doctors, 1/10 thought it was too spicy”.

    This is insane. Thai food is known to be spicy, they were warned that the dish couldn’t be made milder, they knew they did not handle spice well, they still ate it.

    Scientifically their claim doesn’t make sense. The capsaicin in peppers simulate your neurons to make them think they’re burning, but they’re not, and it generally isn’t enough to cause any physical harm, just temporary pain. The quantity of capsaicin needed to cause real damage is far higher than anything in peppers; you’d have to eat something like >400 jalapeno peppers.

    I have enough problems convincing Thai restaurants to make the dish extremely spicy, this’ll make it worse.

    If you know you can’t tolerate spicy foods, it’s insane to go to a Thai restaurant and order something spicy. You should know better

    No it didn’t, or if it did, it was due to actual thermal heat. Chilli doesn’t do that, especially not moderately hot peppers like Thai.

    What a joke, they aren’t even that spicy and commonly used all over the world. Was thinking they had reapers or something.

    Bet it will be thrown out when the defense has no proof of permanent damage.

    This whole lawsuit is a mess but I’m actually surprised this is the first of this type of thing I’ve heard of considering how many dishes and products are labeled to be super spicy/ghost pepper/habanero but actually have very little spice.

    I could absolutely see people thinking that because they can eat a bag of habanero lays they could eat a dish with actual habaneros and then getting absolutely fucked.

    As someone in the California Bay Area, near San Jose, this doctor is so full of shit it’s coming out of his ears. There’s not a remote chance in frozen over hell that he lives in San Jose and doesn’t know that Thai spicy hits different. Dudes either so incompetent that he should lose his license or such a bser that he should be counter sued.

    She’s an asshole. My dad ate 53 fresh jalapeños for a contest at Chi Chi’s back in the day and tied with another guy FTW—got sick afterwards. He also ate a habanero and a habanero select on dares and was sick for a week. Did he have permanent damage? No. This is stupid.

  23. I really wanted to fly out there and try the food. Then I read what type of pepper it was.

    Birds Eye Chili.

    They have less heat than a habanero. A mild habanero and an extra spicy Birds Eye might be on par with each other.
